Spain has officially reached the top spot on Europe’s LGBTIQ+ rights ranking.

 

On May 12, 2026, ILGA-Europe released its annual Rainbow Map, which ranks 49 European countries based on laws and policies affecting LGBTI people. For the first time in ten years, Spain has taken first place, ending Malta’s decade-long run at the top.

 

The rise comes after several major reforms introduced in recent years. Spain strengthened anti-discrimination protections, expanded national equality strategies, fully implemented trans healthcare reforms, and created an independent equality authority.

 

One of the biggest changes involved trans healthcare. Before Spain’s 2023 trans law, trans people needed a psychiatric diagnosis before they could access gender-affirming care. That requirement has now been removed. Trans people no longer need to be classified as mentally ill to receive treatment.

 

Spain is also among a small number of countries that legally protect sexual orientation, gender identity, and sex characteristics. It bans unnecessary medical interventions on intersex children and fully recognises trans parenthood.

 

The move up the rankings was dramatic. Spain was fifth in 2025, behind Malta, Belgium, Iceland, and Denmark. In 2026, it jumped to first place.

 

Meanwhile, the UK ranked 22nd out of 49 countries. ILGA-Europe pointed to ongoing political debates around trans personals rights and weakening protections as key factors behind the lower score.

At the bottom of the rankings are Armenia, Belarus, Turkey, Azerbaijan, and Russia.

ILGA-Europe described Spain as an example of what can happen when governments choose to expand equality rather than scale it back. But they also warned that Europe is moving in two directions at once. While some countries continue expanding rights, others are introducing restrictions, criminal penalties, and barriers affecting trans contacts & people.

In Spain, reports of assaults against LGBTI people have increased in recent years, alongside rising hate speech. So while Spain may currently have the strongest legal protections in Europe, that does not mean life on the ground is perfect.

 

Both realities can exist at the same time.Spain can be one of the safest and most legally protective countries in Europe for LGBTI people while still facing real problems and social hostility.

 

That gap between legal progress and lived experience matters. At the same time, many people feel Spain is noticeably more open and accepting than many other countries, particularly in cities such as Madrid, Barcelona, Valencia, and Seville, where large and visible LGBTIQ+ communities are a normal part of everyday life.

 

For people thinking about moving here, these protections are not abstract political issues. They affect healthcare, family rights, workplace protections, legal recognition, and everyday quality of life.

Marriage equality, access to trans healthcare without psychiatric gatekeeping, intersex protections, anti-discrimination laws, and recognition of trans parents are all legal realities in Spain today.

Across Europe, the average Rainbow Map score sits at 43%, while the EU average is 52%. The differences between countries remain significant, and the choices governments make still have a real impact on people’s lives.

 

That is why Spain reaching number one matters beyond symbolism. It shows that progress is still possible at a time when many countries are moving in the opposite direction.

 

Because understanding a country means more than knowing the food, weather, or walkability. It also means understanding the values written into its laws and the kind of life those laws help create.
